A New York state Supreme Court ordered all New York City employees who were fired for not being vaccinated to be reinstated with back pay.
Supreme Court Justice Ralph Porzio stated that the city’s requirement for government workers to be vaccinated was “arbitrary and capricious".
The court found Monday that "being vaccinated does not prevent an individual from contracting or transmitting COVID-19."
In this lawsuit, 16 sanitation workers, sued the city. Over 1,700 NYC employees were fired for being unvaccinated.
This groundbreaking ruling opens the door for all government employees fired for being unvaccinated, to sue for unlawful discrimination.
Finally, a judge with integrity. Hopefully we will see more such cases.
